ICO’s enforcement is lacking in the field of employee monitoring

In October 2023, the UK Information Commissioner’s Office published their long-awaited guidance on workplace monitoring. According to the ICO, this guidance aims to “help provide greater regulatory certainty; protect workers’ data protection rights; and help employers to build trust with workers”. This guidance is crucial, given that the vast majority of people will have their personal data processed by their employer, and are likely to be subject to some form of workplace monitoring. The latest figures(1) from the Office for National Statistics (ONS) show that 75.5% of the UK is in employment.
