EU Council publishes its position on the application of the GDPR

The European Union’s Council of Ministers declares that while the GDPR is, in general, a success, several areas need more attention. By Laura Linkomies.

The Council’s position(1) , dated 19 December 2019, feeds back on the views of the Member States to the European Commission, which is due to submit a first report on the evaluation and review of the Regulation to the European Parliament and the Council by 25 May 2020, followed by reports every four years thereafter.

The Council takes the view that its positions and findings should not be limited to the topics specifically mentioned in Article 97(2)2 of the GDPR, i.e. data transfers and the cooperation and consistency mechanism. Furthermore, the Commission should take into account the experiences and input of relevant stakeholders.
