ICO to produce codes of practice on edtech and automated decision making

As the Data Bill moves to the Report stage in the House of Commons, the government has said it will ask the ICO to produce codes of practice on edtech, and automated decision-making and AI.

An area that has generated much discussion is the Bill’s provisions on scientific research. At the second reading on 12 February, Peter Kyle, Secretary of State for Science, Innovation and Technology, said that this topic is likely to be debated in considerable depth in Committee. Proceedings in the Public Bill Committee will need be brought to a conclusion by 18 March 2025.

The government has made an amendment to Art. 25 of the UK GDPR (data protection by design and default) which will affect social media companies and streaming sites. This amendment imposes additional duties for these companies when assessing the appropriate technical and organisational measures when designing their services. The government has indicated that organisations already following the ICO’s Age-appropriate Design Code should not find it difficult to comply with the new duty.

PL&B’s Conference on 11 March in London, “What's right for children and their data? Keeping on the right side of the law” will include presentations from companies, the ICO, NGOs, academics and A&O Shearman lawyers. Register by 18 February with early bird fees.
