Getting ready for the Data (Use and Access) Act

DUAA implementation has started, and further implementing regulations are expected soon, as well as consultations on codes of practice. By Laura Linkomies.

At the 1 October PL&B conference about maximising opportunities with the Data (Use and Access) Act (DUAA) 2025, hosted by Linklaters, Greg Palmer, Partner, first put DUAA in a larger context of UK adequacy. As we know, UK adequacy expires on 27 December 2025. The EU Commission seems highly likely to extend it, Palmer said. The UK law has so far been reinforced by the European Convention on Human Rights (ECHR). Loss of UK adequacy would be catastrophic, as the EU accounts for 41% of total UK exports and 51% of UK imports, and it would implicitly mean the UK is not a safe place for EU data, he said.
