Appeal Court supports Belgian DPA against Real-Time Bidding

The landmark court decision is a big win for Belgium’s DPA, Hielke Hijmans, Chairman of the Litigation Chamber and member of the Board of Directors of the Belgian Data Protection Authority (DPA), and also a Professor at Vrije Universiteit Brussel told PL&B in Brussels on 20 May.
The case, which originated in 2018 deals with tracking-based advertising and individual consent. The decision delivered on 14 May(1) now confirms the Belgium DPA’s view that such advertising had no legal basis when relying on IAB Europe’s Transparency & Consent Framework (TCF) to obtain consent for data processing.
