Which legal principles apply to employee privacy and how has Deutsche Telekom applied them to its employees’ use of Facebook’s WhatsApp? By Merrill Dresner.

Anyone who works for a business which has EU based employees needs to understand the legal framework: “We are not just talking about the GDPR here, as there are a plethora of other laws and guidance that are relevant” said Ann Bevitt, Partner, Cooley, UK at the Privacy Laws & Business 32nd Annual International Conference on 3 July in Cambridge.

In the UK, organisations rely on Article 8 of the European Convention on Human Rights (ECHR) when looking at employee monitoring. The original ICO’s Employment Practices Code is still helpful and useful, although it now needs to be looked at through the lens of the GDPR. “Employee privacy is one of the less harmonized areas of European Community law,” she said, focusing on four employee privacy hotspots.
