1. Government proposes £500,000 upper limit for data protection fines

The United Kingdom Government proposes to set the maximum penalty for serious breaches of the Data Protection Act at £500,000. The Information Commissioner is to decide when a fine should be imposed. The Information Commissioner's Office (ICO) will publish detailed guidance setting out the criteria it will use when serving a monetary penalty notice.

A consultation on the monetary penalty was launched on 9 November and will run until 21 December 2009.
