ICO issues new guidance on subject access requests



The ICO has today published new guidance on how to respond to subject access requests. The guidance takes into account many of the 350 responses to its consultation. As a result, the ICO has relaxed its position so that now:

  1. organisations can stop the clock when responding to requests if they are waiting for requesters to provide more details on what they want
  2. there is greater clarity on when to regard a request as manifestly excessive, and therefore not needing a full response
  3. the guidance states the points organisations can take into account when charging an administration fee for excessive, unfounded or repeat requests in a short time frame.
