ICO consults on automated decision-making, including profiling



The ICO is currently consulting on its DUAA-related updates to the guidance on automated decision-making (ADM). The draft guidance serves as an update to the existing guidance on automated decision-making and profiling. For example, the ICO is seeking views on whether organisations agree with its definitions on what constitutes a decision, a significant decision or a solely automated decision.

The consultation also seeks to understand to what extent respondents agree with the lawful basis, including examples of consent, contract, public task and legitimate interests. In addition, respondents are asked about their views on the safeguards regarding ‘information about decisions’, ‘making representations’, ‘human intervention’ and ‘contest’.

The ICO is also interested on the costs and benefits to organisations resulting from the draft guidance on ADM, and what practical challenges arise when individuals use their rights to challenge ADM.
