As the COVID-19 pandemic caused major shifts in technology adoption and increased reliance on technologies and infrastructures, calls for ‘digital sovereignty’ escalated globally. Sorting populations back into their nations of passport enabled new means of establishing and justifying borders with long term closures and the introduction of new digital identity infrastructure such as vaccine passports. Besides bidding to form future models for data governance and the data economy, the EU has also laid out plans to pioneer legislation governing the use of Artificial Intelligence. In this pivotal moment, engaging in transatlantic, multidisciplinary dialogue has become of central significance. Amidst all these developments, what does the future hold for data protection?
On Wednesday 25 May Laura Linkomies moderated the session Practical Legal Perspectives on International Transfers.
There remains considerable uncertainty as to how international transfers of personal data under the GDPR should be legitimated. Data controllers and processors in the EU are are often left in a state of confusion as to whether, and how, they might engage in international transfers. Questions swirl concerning, for example, which approaches might be used in relation to which countries, as to the degree to which evaluations of national laws in third countries should be carried out, and as to how the situation may change in future. Against this background, this panel brings together practicing lawyers who deal with the legitimation of international transfers under the GDPR on a daily basis. Panelists will offer their perspectives on the current situation issues and will consider, amongst others, the following questions:
- What are the best ways to legitimate international transfers, and why?
- What novel approaches have come to the fore in dealing with international transfers over the past couple of years?
- How should lawyers deal with the ongoing uncertainty surrounding the legitimation of international transfers?
- What can legal practice tell us about policy solutions moving forwards?

CPDP is an annual three-day conference devoted to privacy and data protection. The 14th edition of CPDP will be held on 27th to 29th January 2021 online*.
As humanity is facing a global pandemic reshaping our lives, governments are discussing measures ranging from contact tracing apps to immunity passports and long-term border restrictions. Meanwhile, a considerable part of our daily lives is moving online as telemedicine and online classrooms substitute in-person encounters. Amidst these changes, this year’s overarching CPDP theme “Enforcing Rights in a Changing World” asks how data protection and privacy are maintained post-pandemic.
CPDP2021 will serve as a platform to discuss, and seek answers, to these questions and many more.
