Brazil: CORRECTION

PL&B's previous enews today about Brazil issuing a 1.2 million euros fine quoted the wrong legislation. According to Professor of Law, Danilo Doneda, the case was not based on Brazil's new Brazilian's internet law (Marco Civil da Internet), but rather on Brazil's consumer law which dates back to 1990. We apologise for this error.

Professor Danilo Doneda is Advisor to Brazil's government on data protection law, and Coordinator of Supervision and Control Department, Consumer Defence and Protection, Secretariat of Economic Law, Ministry of Justice, Brasília. He responded quickly to our e-news with this correction, writing to PL&B: "In fact, it wouldn't be possible to apply the new law to the case involving Oi and Phorm, as the issues at stake were prior to the new law."
